Ordinance number 06-07-16-3. An ordinance vacating and closing Mill Street and a Portion of Canal Street, which lies in Laceyville Borough, Wyoming County, Pennsylvania; and directing that the same be removed from the official borough plan of the code of the borough of Laceyville, County of Wyoming, Commonwealth of Pennsylvania. It is hereby ordained and enacted by the Borough Council of Laceyville Borough, Wyoming County, Pennsylvania, as follows: Whereas, in the judgment of the Borough Council of Laceyville Borough, it is necessary that Mill Street and a portion of Canal Street be vacated; and Whereas said road to be vacated abuts on lands owned by: Robert F. Otto and Linda I. Otto, with parcels of 09-090.1-124-00-00-00 and 09-090.1-129-00-00-00. The roads to be vacated are described as follows: All those certain roads situate, lying and being in the Borough of Laceyville, County of Wyoming, and Commonwealth of Pennsylvania, bounded and described as follows: Beginning at a point on the property line of Robert F. Otto and Linda I. Otto in Canal Street, as marked by an iron pin on a map surveyed by James Walton, Map W-793-1 completed March 13, 1996, and recorded in the Wyoming County Courthouse, said road being twenty-five feet wide and traveling in a westernly direction; Thence making a roughly ninety-degree angle, traveling north, and becoming Mill Street, said road being thirty-three feet wide and depicted on Map W-793-1 as noted above, and terminating at the intersection of Franklin Street. Being the portions of the roads known as Canal Street and Mill Street located in Laceyville Borough as shown on a map entitled "Plan of Minor Subdivision Made for Thomas R. Bartha, et ux" by James Walton and Douglas Walton, Professional Land Surveyors, completed March 13, 1996 and approved by the Wyoming County Planning Director on May 1, 1996, Map W-793-1, recorded in the Wyoming County Courthouse to Map Book 15, Page 30. This parcel is subject to any and all Rights-of Way, easements, and/or Agreements that may be over and across, or under the same, whether visible and invisible, or that may be of record for said premises. Whereas after due notice having been given, a hearing was held which affected property owners and interested parties were permitted to be heard. Be it and it is hereby ordained by the Laceyville Borough Council under the authority of the Borough Code as follows: Section I. That Canal Street be vacated from the property line of Robert F. Otto and Linda I. Otto, and closed the entire length westward from that point. Section II. That Mill Street be vacated the entire length from Canal Street to Franklin Street. Sections III. A copy of this Ordinance together with a draft or survey of the vacated portion of said road showing the location and width thereof is directed to be filed in the Office of the Clerk of the Court of Common Pleas. Section IV. This Ordinance shall become effective thirty (30) days after the filing of the said copy thereof and the plan of survey referred to in Section III. Section V. All Ordinances or parts of Ordinances inconsistent herewith are hereby repealed. Enacted by the Borough of Laceyville
