It is alleged that subsequent to a motor vehicle accident near Cold Creek Road that Cherry identified himself as Brian Cherry and that he was driving another individual's vehicle. It was subsequently determined that there was a warrant for his arrest in Texas. His preliminary hearing date is April 6.
Boyd Howard Fenton, 20, Rome, faces prosecution for DUI, resisting arrest, failure to give immediate notice to police after an accident and summary traffic violations for alleged offenses on Jan. 1 at 3:08 a.m. on Route 187 south of Rome Borough. His BAC was reported at .129. He was additionally cited for driving in the wrong lane, driving at an unsafe speed and driving without a seat belt. It is alleged that the accused left the scene of an accident in which the vehicle was left in a cornfield. Approximately an hour later he was contacted at his residence where he stated he had been sleeping, becoming combative when confronted by the investigating state trooper. He became compliant after the trooper utilized his taser. His preliminary hearing date was March 16.
